1. About these terms
These Terms & Conditions apply when you access the SEALIX website, create an account, request advice, obtain a quote or purchase products from Sealix Pty Ltd, ABN 74 685 530 223.
By placing an order, you agree to these terms and the policies linked from them. Our Delivery Policy, Refund Policy and Privacy Policy form part of these terms where relevant.
If a dedicated policy deals with a specific delivery, return or privacy matter, that policy applies to that matter.
2. Product information and suitability
We take reasonable care to keep product names, descriptions, images, pack sizes, coverage information and availability accurate. Packaging, labels or product presentation may change without affecting the product itself.
Colours shown on a screen are a guide only. Timber, stone and concrete vary in colour, porosity, condition and previous treatment, so the final appearance and coverage can differ from examples.
Before ordering or applying a product, check that it is suitable for your surface, preparation method, desired result and site conditions. Ask SEALIX before ordering if you are unsure, and complete a test area before the full application wherever practical.
3. Orders and acceptance
Placing an order is an offer to buy the products in your cart. An automated order or payment confirmation means we have received the order; it does not prevent us from contacting you before dispatch if something needs to be corrected.
We may decline or cancel an order before dispatch where a product is unavailable, a price or system error is clear, payment is not completed, the delivery address cannot be serviced, or we reasonably suspect fraud or misuse. If we cancel a paid order, we’ll refund the affected amount.
Contact us immediately if you need to change or cancel an order. Changes may not be possible once goods have entered dispatch or once custom tinting, mixing or special ordering has started.
4. Pricing and payment
Website prices are in Australian dollars and include GST unless clearly stated otherwise. Delivery charges and any available discounts are shown before payment.
Payment is due when the order is placed unless SEALIX agrees otherwise in writing. Available online payment methods are shown at checkout and currently include card payments processed through Stripe and PayPal where offered.
If an obvious pricing or system error is identified before dispatch, we’ll contact you. You can confirm the order at the correct price or cancel the affected item for a refund. We will not charge an increased amount without your agreement.
5. Stock, backorders and substitutions
Stock information can change between adding a product to the cart and processing the order. If an item is unavailable or delayed, we’ll contact you with the available options.
You may choose to wait, change to an agreed alternative or receive a refund for an item we cannot supply. We will not substitute a materially different product without your agreement.
6. Delivery and store pickup
Delivery areas, charges, dispatch timing, same-day services, split deliveries, restricted freight, tracking and Dandenong pickup are explained in our Delivery Policy.
Check your address and contact details before ordering. Delivery estimates are not guaranteed arrival dates unless SEALIX expressly agrees to a firm date in writing.
7. Returns, refunds and replacements
Change-of-mind conditions, the $25 restocking fee, return collection, return freight, faulty or damaged products, refunds and replacements are explained in our Refund Policy.
Contact SEALIX before sending any product back. Coatings, cleaners and other liquids may have transport restrictions and must use the return method we arrange.
8. Product advice and photo assessments
SEALIX provides practical guidance based on the information, measurements and photos you supply. Remote advice and photo assessments are not an onsite inspection and may not reveal every surface condition, previous coating or site issue.
You are responsible for giving accurate information and checking the product instructions, coverage, preparation requirements and site conditions before starting. Contact us again if the surface or job differs from what was originally described.
9. Safe storage and product use
Read and follow the product label and instructions before opening, mixing, applying or disposing of a product. Use suitable protective equipment, ventilation and site controls for the product and job.
Store products securely, in their original containers, away from children, ignition sources and unsuitable temperatures. Do not combine products unless the instructions specifically say they can be combined.
SEALIX is not responsible for problems caused by misuse, incorrect storage, unsuitable application conditions, incomplete preparation or failure to follow product directions, to the extent permitted by law.
10. Website accounts and acceptable use
Keep your account details accurate and your password confidential. You are responsible for activity performed through your account unless you have notified us that it may have been compromised.
You must not misuse the website, interfere with its operation, attempt unauthorised access, upload harmful content, impersonate another person or use the site for unlawful or fraudulent activity.
We may restrict or suspend access where reasonably necessary to protect customers, SEALIX or the website.
11. Website content and customer uploads
SEALIX owns or licenses the website content, branding, copy, graphics, guides, photographs and other materials. You may use them for personal, non-commercial reference but must not reproduce, sell or republish them without permission.
When you upload a photo, file or message, you confirm that you are allowed to provide it. You give SEALIX permission to store, review and use it only as reasonably needed to answer your enquiry, provide support or manage the related order.
We will not use customer photos in advertising, case studies or social content without separate permission.
12. Promotions and discount codes
Promotions, discount codes, bundles and giveaways may have separate conditions, dates, eligible products or minimum order values. Those specific conditions apply in addition to these terms.
Unless a promotion states otherwise, offers cannot be exchanged for cash or applied after an order has been completed.
13. Responsibility and rights that cannot be excluded
Nothing in these terms excludes, restricts or changes any right or remedy that cannot legally be excluded.
To the extent permitted by law, SEALIX is not responsible for indirect loss or for loss caused by incorrect information supplied to us, misuse, unsuitable site conditions, incomplete preparation, unauthorised product combinations or failure to follow product directions.
14. Changes and governing law
We may update these terms when the website, services or business practices change. Updated terms apply to future website use and future orders from the date they are published. An order already placed remains subject to the terms applying when it was placed.
These terms are governed by the laws of Victoria, Australia. The parties submit to the courts with jurisdiction in Victoria.
