Below is a comprehensive set of Terms and Conditions tailored for Sealix Pty Ltd. These Terms cover ordering, payment, delivery, returns, warranties and liabilities, intellectual property, governing law and more, in line with good e-commerce practice and Australian law.

These Terms and Conditions govern your access to and use of Sealix’s website and the purchase of goods from Sealix Pty Ltd. They form a binding agreement between you (“you” or “Customer”) and Sealix and set out your and our rights and obligations when you place an order for surface-care and protection products on Sealix. They cover order acceptance, payment, delivery, returns, warranties, liability limits, intellectual property, dispute resolution and the applicable law.

1. Acceptance of Terms

1.1 Agreement to Terms

By accessing or using our website and placing an order for Goods, you agree to be bound by these Terms and any policies expressly incorporated by reference. If you do not agree to these Terms, you must not access the website or place an order.

1.2 Changes to Terms

We may revise these Terms at any time by updating this page. Your continued use of the site or placement of an order after changes are posted constitutes your acceptance of the new Terms.

2. Definitions

To avoid ambiguity, we define key terms as follows:

  • Goods: all products sold by Sealix, including sealers, cleaners, coatings and tools.
  • Customer: the individual or entity purchasing Goods.
  • Site: the Sealix website at Sealix.
    Definitions and interpretations are set out to clarify rights and obligations under these Terms.

3. Orders and Pricing

3.1 Order Acceptance

All orders are an offer to purchase Goods and are subject to our acceptance. We may refuse or cancel any order at our sole discretion, including due to errors in pricing or product availability.

3.2 Quotes and Validity

Where we provide a written quote, it remains valid only for the period specified in the quote. If no period is specified, quotes expire 30 days from issue.

3.3 Pricing and GST

Prices displayed on the Site include GST unless otherwise stated. We reserve the right to amend prices at any time prior to accepting your order.

4. Payment

4.1 Payment Terms

Payment in full is due at the time of ordering, unless otherwise agreed in writing. Title to Goods does not pass until we receive full payment.

4.2 Accepted Methods

We accept payment via credit card, PayPal and Shopify Payments, subject to the terms and conditions of the payment provider.

4.3 Late Payment

Overdue payments may incur interest at a rate of 1.5% per month (or the maximum permitted by law) on the outstanding balance.

5. Delivery and Shipping

5.1 Shipping Costs and Timing

Shipping costs and estimated delivery times are displayed at checkout. Delivery dates are estimates only and we are not liable for delays outside our control.

5.2 Risk and Title

Risk in the Goods passes to you upon dispatch. Legal title in the Goods remains with Sealix until full payment is received.

6. Returns and Cancellations

6.1 Cancellation by Customer

You may not cancel or modify an order after we have accepted it, except with our prior written consent and subject to any restocking fees.

6.2 Returns for Defects

Subject to your consumer rights under the Australian Consumer Law, you may return defective Goods within 14 days of delivery for repair, replacement or refund. Proof of purchase is required.

7. Warranty and Liability

7.1 Warranty Period

We warrant that supplied Goods conform to their specifications and are free from defects in materials and workmanship for 12 months from delivery.

7.2 Limitation of Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising under or relating to these Terms will be limited to the purchase price paid for the relevant Goods.

8. Intellectual Property

All intellectual property rights in the Site, its content and the Goods (including any trademarks and designs) remain the property of Sealix or its licensors. Nothing in these Terms grants you any rights to that IP.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria to resolve any dispute.
